Your Monthly Price: The Broadband Facts provide information regarding standalone Internet plans available to new customers in your area. The “Monthly Price” on the Broadband Facts label is the base monthly retail rate for our standalone Internet plan. Additional monthly and one-time charges (over and above the Monthly Price) are listed separately. The price does not, however, reflect certain discounts or other pricing options that may be available to you, such as those for bundling broadband with other services. From time-to-time different discounted pricing may be offered in particular service areas. We explain some of those options further below. Non-Introductory Pricing; Future Price Changes: Unless otherwise provided on the label, the Monthly Price is non-introductory. This means that the Monthly Price will not automatically increase after expiration of a period time, like 12 or 24 months, and you are not bound by a contractual term, so you can terminate services without an early termination fee. The Monthly Price will only be increased if we send you prior written notice of the increase, which will give you the opportunity to then explore service options available to you from WOW! Business or other providers. Discounts, Pricing Options and Service Bundle Information: To further help you comparison shop among service plans offered by WOW! Business and other operators, we describe below discounts, pricing options and service bundles or “add-ons” that may be available to you and may result in pricing discounts that could lower your base Monthly Price, or otherwise provide attractive service bundling options. The discounts, pricing and bundling options we describe here have some requirements and limitations that we describe in more detail below. Also, the available discounts, pricing and bundling options may vary by sales channel (i.e., the way you purchase services from WOW! Business, such as online or by calling us), your service location and when you purchase services from us. The discounts, pricing and bundling options we describe here will change from time to time, and there may be other available incentives not described here. If you subscribe to a service plan that has an available monthly discount or other incentive, that discount or incentive may change in the future. If it does, we’ll give you advance notice, so you have the chance to explore other service options available to you from WOW! or other providers. Installation & Construction Fees: In most cases, the “standard” installation fee identified on the label will apply. A “standard” installation involves a typical extension of our plant to your service location that is proximate to our existing plant and facilities. If, however, your business location requires that we construct additional plant or need to supply additional equipment or facilities, we may charge you for these additional costs, over and above the standard installation fee. Before that occurs, we will discuss those additional fees with you and provide you with pricing options that may be available to you. For example, we may customize the agreement so that you either pay the construction charges upfront or in agreed upon installments over time. Price Lock Guarantee: Price guarantee locks-in monthly rate of Business Internet for the length of a 12 or 24 month term agreement and is valid on Internet rate only. Price guarantee excludes taxes, fees and equipment. Term Agreements & Early Termination Fees: The base service offer reflected on the label is a month-to-month service offering. So, no term contract is required. Depending upon the needs of your business, however, we will typically discuss and negotiate other pricing options, which may include term agreements. The benefit of a term agreement (typically 12 or 24 months) is that your base Internet Monthly Price will not increase during the term (see above description of Price Lock Guarantee), so long as you remain a customer in good standing. If, however, you terminate your services before expiration of the term, you may be subject to an early termination fee. Our standard early termination fee (described in both our business service order form and business service terms and conditions) provides that Customer’s termination of the Agreement or Customer’s reduction of Services (“downgrade”) before the expiration of the agreed upon Term without cause (including a termination for convenience) or WOW!’s early termination of the Agreement for cause, will require that Customer pay to WOW! an early termination fee (ETF) calculated as follows: (a) all unpaid amounts for Services provided through the date of termination; plus (b) all related reasonable expenses of WOW! including, but not necessarily limited to, construction and installation costs, discounts, credits or competitive contract buyout charges and/or all previously waived non-recurring charges for the Services; plus (c) 75% of the monthly recurring charges at the rates stated in an applicable Service Order form or, in the case of a downgrade, the difference between the monthly recurring charges (MRC) at the rates stated in the original Service Order form and the MRC at the rates for the downgraded service, for all months remaining in the applicable Service Order Term. Customer agrees that WOW!’s damages for early termination would be difficult to determine and the termination charges specified herein constitute liquidated damages and are not a penalty. Month-to-month service agreements may be terminated on thirty (30) days prior written notice. If Customer provides notice of termination as specified in this Section but retains WOW! Service, the Customer will be converted automatically to a month-to-month agreement at the end of the current term, and Customer’s pricing for the Service will be modified to reflect WOW!’s current month to month pricing schedule. To terminate this Agreement in accordance with this Section, Customer must notify WOW! Customer Care by written notice to WOW! at WOW! Internet, Cable & Phone, Attn: VP of Business Operations, 7887 E Belleview Ave, Suite 1000, Englewood, CO 80111-6015. The rights and remedies set forth herein shall be in addition to any and all other legal, equitable and administrative rights and remedies available to WOW!. Modem/EMTA Lease: Free modem/EMTA rental is available for 6 or 12 months, depending on the service location of the business. Regular rate (currently $11 per month) applies after 6 or 12 month period, or customer may provide their own modem. Internet & Phone Bundle Discount: Bundle any high-speed Business Internet package with one voice line and receive $10 off monthly recurring Internet charges. Discount amount depends upon the required minimum speed tier and requires a minimum 12 month term. Early Termination Fee applies. Internet & Whole-Business WiFi Bundle Discount: Bundle any high-speed Business Internet package with Whole Business WiFi and receive $10 off monthly recurring Internet charges. Discount requires a minimum 12 month term. Early Termination Fee applies.
